Prices of notary services and notarial acts in Lithuania

In Lithuania, the rates for notary services are set by the state and regularly updated. The services of notaries are necessary when it is necessary to approve documents or perform certain legal actions, for example, when concluding real estate purchase and sale agreements, inheritance cases, approval of divorce agreements and others. New rates set by the Ministry of Justice of the Republic of Lithuania entered into force in 2023.

For example, the cost of basic services, such as approval of a real estate purchase and sale agreement, now depends on the amount of the contract: the higher the amount, the higher the notary fee. However, there are also minimum fees that apply for various notary services. This is to ensure that all people can use the services of notaries at an affordable price. Notary services are subject to VAT (value added tax), so the final price of notary services may be higher.

Seimas in 2022 December 20 adopted amendments to the Law on Notary of the Republic of Lithuania, which established that the amount of remuneration for the performance of notarial acts and the cases of exemption from its payment shall be determined by the Government in accordance with its approved methodology for determining notary remuneration amounts (rates).

This methodology was approved in 2023. January 25 by the Government’s resolution, and the Government approved the new rates for notarial actions in 2023. June 28

Rates of notarial actions

Rates for approval of real estate transactions

  • for the confirmation of the contract of transfer of real estate, transfer for property debt (debt settlement) or transfer of property for rent, unless otherwise specified in this section – 0.37% of the price of the real estate specified by the parties to the transaction, but not less than 76 EUR and not more than 5,000 Eur;
  • for the approval of a real estate lease, financial lease (lease) agreement – 0.46% of the amount of rent specified in the agreement (calculated for the entire lease term, no longer than 25 years), but not less than EUR 76 and not more than EUR 5,000 ;
  • for the approval of the contract for the use of real estate, its merger, its division, land plot separation, amalgamation or land consolidation – 0.46% of the value of the real estate, but not less than EUR 76 and not more than EUR 5,000;
  • for approving the gift of an immovable object to a spouse, parents (adoptive parents), children (adopted children), grandparents, grandchildren or an exchange agreement between these persons, as well as in cases where an immovable object is exchanged for a movable object or another object of civil rights – 0.04% from the value of the immovable object specified by the parties to the transaction or the value of the exchanged object with a higher value, but not less than EUR 38 and not more than EUR 200;
  • for the approval of the agreement establishing the servitude(s), usufruct, right of pledge, use of the immovable object – 105 EUR.

Movable transaction confirmation rates

  • for approving the contract of transfer, use, sharing, exchange, transfer for property debt or transfer of property for rent – 0.18% of the price of the movable item specified by the parties to the transaction or the value of the exchanged object with a higher value, but not less than 34 EUR and no more than EUR 5,000;
  • for the approval of the lease or financial lease (lease) agreement of a movable object – 0.18% of the amount of rent tax specified in the lease agreement (calculated for the entire lease term) or the price specified in the financial lease (lease) agreement, but not less than 34 EUR and no more than EUR 5,000;
  • for the approval of the gift of a movable object to a spouse, parents, children (adopted children), grandparents, grandchildren or an exchange agreement between these persons – 0.04% of the value of the movable object indicated by the parties to the transaction, or the value of the exchanged object with a higher value, but not less than 34 EUR and no more than 200 EUR.

Approval rates for transfer, share, loan and credit transactions of securities, money or rights

  • for securities, rights (except for the approval of the mortgage (pledge) claim (right) transfer agreement and for the approval of the inheritance right purchase-sale agreement) – 0.26% of the price of the transfer of securities, rights, the amount of money donated or the object to be exchanged, having a higher value, but not less than EUR 24 and not more than EUR 5,000;
  • for the approval of a claim transfer or debt transfer agreement or claim – 0.26% of the claim, the amount of the debt at the time of concluding the contract, but not less than EUR 24 and not more than EUR 5,000;
  • for the approval of a contract of gifting securities, rights, money to a spouse, parents, children (adopted children), grandparents, grandchildren or an exchange between these persons – 0.04% of the value of the gift object specified by the parties to the transaction or of the value of the exchanged object with a higher value, but not less than EUR 12 and not more than EUR 200;
  • for the approval of a loan or credit agreement – 0.26% of the amount of the loan (credit) or the value of the item, when the object is not money, but not less than EUR 24 and not more than EUR 5,000;
  • for promissory note approval – 0.07% of the promissory note amount, but not less than EUR 12 and not more than EUR 5,000;
  • for the approval of the agreement on the sharing of monetary funds – 0.17% of the amount of monetary funds, but not less than 24 EUR and not more than 5,000 EUR;
  • for the approval of the rights sharing agreement – 48 EUR.

Rates of notarial actions related to mortgage and/or pledge

  • for the approval of a real estate mortgage, unless otherwise stated in this section, up to EUR 220,000 of the value of the pledged object – 0.25% of the value of the pledged object, but not less than EUR 54 and not more than EUR 190, and from the value of the pledged object of EUR 220,001 – 0, 25% of the value of the pledged item, but no more than EUR 360;
  • for the approval of the company’s mortgage transaction – 0.33% of the total value of the company, but not less than EUR 54 and not more than EUR 2,500;
  • for confirmation of pledge – 0.25% of the value of the pledged item, but not less than EUR 54 and not more than EUR 360;
  • for the approval of the mortgage (pledge) claim (right) transfer agreement – 0.08% of the amount of the mortgage claim (right), but not less than EUR 54 and not more than EUR 485;
  • for issuing a certificate of mortgage (pledge) registration (at the request of an individual) – 5 EUR.
  • for the approval of the establishment transaction of a legal entity – 0.2% of the amount of the authorized capital of the established legal entity (if it is determined according to the legal form of the legal entity), but not less than EUR 269 and not more than EUR 338;
  • for the confirmation of compliance of the incorporation documents of the established legal entity with the requirements of the law, as well as for the confirmation that the legal entity can be registered, because the obligations set out in the laws or in the founding transaction have been fulfilled and the circumstances specified in the laws or founding documents have arisen – a) charity and support fund, individual companies, small associations – 75 EUR; b) public institution, municipal company, agricultural company, cooperative company (cooperative), association, partnership (professional association of lawyers, multi-apartment residential houses and/or) recreational (leisure), creative (creative workshops) or economic (garages and other) purpose buildings, as well as one- and two-apartment housing associations) and other legal entities not specified in this Price List – EUR 100; c) closed joint stock companies – 210 EUR; d) joint-stock companies, European economic interest groups, European companies, European cooperative companies, permanent arbitration institutions, commercial banks, credit unions and other credit institutions, companies performing insurance activities – EUR 260; e) for the confirmation and amendment of the provisions of the legal entity’s branch or representative office, as well as for the confirmation that the branch or representative office can be registered because the obligations set forth in the law have been fulfilled and the circumstances specified in the law or in the founding documents have arisen – from 50 to 75% of the fee, determined according to the legal form of the legal entity;
  • for members of the management bodies of the legal entity, members of other bodies, shareholders, persons who have the right to enter into transactions on behalf of the legal entity (certificate of the authenticity of all data and signature of each person) – 10 EUR;
  • for the approval of the new version of the legal entity’s amended founding document in accordance with the requirements of the law, when:
  • the size of the legal entity’s capital is changed – 0.20% of the amount of the authorized capital to be increased or decreased, but not less than EUR 269 and not more than EUR 338;
  • the size of the legal entity’s capital remains unchanged – 135 EUR;

Rates of notarial actions related to inheritance law

  • for the confirmation of the will – 40 EUR;
  • for confirmation of the statement to cancel the will – 15 EUR;
  • for keeping or withdrawing a personal will or a will comparable to an official one – 21 EUR;
  • for publication of the will – 10 EUR;
  • for the confirmation of the statement regarding the acceptance (rejection) of the inheritance or testamentary exclusive acceptance – 34 EUR;
  • for the issuance of a certificate of inheritance to immovable property, monetary funds to the heir(s), preparation of the European Certificate of Inheritance and issuance of its certified copy – 0.09% of the value of the inherited property, but not less than EUR 29 and not more than EUR 400;
  • for the correction, amendment or cancellation of the European certificate of inheritance and the preparation of supporting documents – 0.04% of the value of the inherited property, but not less than EUR 15 and not more than EUR 120;
  • for the issuance of the certificate of the right to a part of the common property of the spouses to the remaining spouse, as well as the certificate determining the part of the property of the deceased spouse – 29 EUR;
  • for the issuance of an executive order for the preparation of a description of assets or an executive order to supplement the description of assets – 20 EUR;
  • for the approval of the agreement on the division of inherited property after the death of the spouse, parents (adoptive parents), children (adopted), grandparents, grandchildren – 0.23% of the value of the property to be divided, but not less than EUR 38 and not more than EUR 400;
  • for the approval of the purchase-sale agreement of the inheritance right – 0.06% of the value of the property, but not less than 24 EUR and not more than 5,000 EUR.
